Welcome to Global Newah Heritage. These Terms of Service (“Terms”) govern your use of the website globalnewah.organd any related services, programs, events, donation processing, and member features we provide (collectively, “Services”). By using our Services, you agree to these Terms. If you do not agree, please do not use our Services.

1. About Us

Global Newah Heritage is a 501(c)(3) nonprofit organization (EIN: 42-2328402) registered in the United States. Our mission is to preserve and celebrate the cultural heritage of the Newari people through language preservation, festivals, traditional arts, and community programs.

2. Acceptance of Terms

By accessing or using the Services, you confirm that you are at least 13 years of age and that you have the legal capacity to enter into a binding agreement. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.

3. Donations

Tax deductibility

Donations to Global Newah Heritage are tax-deductible in the United States to the extent permitted by law. No goods or services are provided in exchange for cash donations unless explicitly noted. We will provide a receipt for every completed donation.

Payment processing

All payments are processed by Stripe, Inc. By donating, you also agree to Stripe's Services Agreement. You authorize us to charge the payment method you provide for the amount specified.

Recurring donations

If you choose a monthly or annual recurring donation, you authorize us to charge your payment method on a repeating basis until you cancel. You may cancel at any time by contacting us at info@globalnewah.org. Cancellation will take effect for future charges; we do not refund already-charged installments unless required by law.

Refunds

Donations are generally non-refundable. If you believe a charge was made in error or you wish to request a refund, please contact us within 30 days of the transaction. Refunds are issued at our discretion and processed back to the original payment method.

Designation of funds

When you designate a donation to a specific program, we will use it for that program. If the designated program is fully funded or discontinued, we reserve the right to apply your donation to a similar program serving the same purpose.

4. Event Registration

RSVPs

By RSVPing to an event, you agree to attend at the date, time, and location specified. If your plans change, please notify us so we can offer your spot to others.

Paid event tickets

Payment for paid events confirms your registration. Tickets are generally non-refundable, but refund requests for unforeseen circumstances may be considered at our discretion. If we cancel an event for any reason, we will issue a full refund.

Event conduct

We expect respectful behavior at all events. We reserve the right to refuse entry or remove anyone whose conduct is disruptive, harassing, or unsafe, without refund.

Photography and recordings

Events may be photographed or recorded for promotional and archival purposes. By attending, you grant us permission to use your image in such materials. If you do not wish to be photographed, please notify an event organizer on arrival.

5. Member Accounts

When you create a member account (currently via Google Sign-In), you agree to:

  • Provide accurate information from your Google account
  • Use the account only for personal, non-commercial purposes
  • Not share your account credentials with others
  • Notify us promptly of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms, are inactive for an extended period, or are used for fraudulent activity.

6. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Upload viruses, malware, or any harmful code; conduct vulnerability scans or penetration testing without our written permission
  • Scrape, harvest, or systematically extract content from the Services
  • Impersonate any person or organization
  • Harass, abuse, or harm other users
  • Use the donation system to launder money, perform card testing, or make fraudulent contributions
  • Send unsolicited communications through our contact forms or newsletter system

7. Intellectual Property

All content on this website — including text, images, graphics, logos, videos, and software — is owned by or licensed to Global Newah Heritage and protected by copyright and other intellectual property laws.

You may view and share our content for personal, non-commercial use with proper attribution. You may not reproduce, distribute, modify, or create derivative works for commercial purposes without our written permission.

Newari cultural materials, traditional knowledge, and heritage content presented on our website are shared with respect for community ownership. We welcome inquiries from community members regarding cultural attribution and proper usage.

8. User-Submitted Content

If you submit content to us — testimonials, contact form messages, event notes, or other communications — you grant us a non-exclusive, royalty-free, worldwide license to use that content in connection with our mission, including in newsletters, on our website, and in reports. You retain ownership of your content. We will not use your name or likeness for endorsements without your explicit consent.

9. Third-Party Services and Links

Our website may contain links to third-party websites or integrate with third-party services (Stripe, Google, Resend, Cloudinary, etc.). We are not responsible for the content, privacy practices, or terms of those third parties. Your interactions with them are governed by their own terms and policies.

10. Disclaimer of Warranties

The services are provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the services will be uninterrupted, error-free, secure, or that defects will be corrected.

We make no warranties about the accuracy, completeness, or reliability of any content on the website, including historical or cultural information.

11. Limitation of Liability

To the maximum extent permitted by law, Global Newah Heritage, its officers, directors, employees, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including but not limited to damages for loss of profits, data, or goodwill.

Our total liability to you for any claim arising out of or relating to these Terms or the Services is limited to the amount you have paid us in the past 12 months, or $100, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Global Newah Heritage from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your use of the Services in a manner that violates any law or third-party right.

13. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms, fraudulent activity, or any other reason at our reasonable discretion. You may close your member account at any time by contacting us.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of laws provisions. Any disputes arising from these Terms or your use of the Services will be resolved in the state or federal courts located in Tarrant County, Texas, and you consent to the jurisdiction of those courts.

We encourage informal resolution first — please contact us before filing any legal action.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top. Material changes will be communicated by email to registered members or through a notice on our website. Your continued use of the Services after changes constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
